Does BillingPlatform use customer data to train AI models?

BillingPlatform does not use customer data to train public or third‑party AI models. Customer data remains the customer’s data at all times. Where AI features are enabled, BillingPlatform applies strict data governance controls consistent with enterprise AI trust frameworks, ensuring data is processed only to deliver the intended functionality.

Is human oversight required when using AI features?

Yes. BillingPlatform’s AI features are designed to support meaningful human oversight. AI outputs are advisory in nature and should be reviewed by users before being acted upon in operational, financial, or legal contexts, consistent with responsible AI best practices.

Are AI features optional?

BillingPlatform AI Privacy Policy

Overview

BillingPlatform is committed to protecting customer data and privacy while delivering trusted, enterprise‑grade artificial intelligence (AI) capabilities. This AI Privacy Policy explains how BillingPlatform collects, processes, and safeguards data when AI‑enabled features are used within the BillingPlatform services.

Customer Data Ownership

Customers retain full ownership and control of their data at all times. BillingPlatform processes customer data solely to provide and operate contracted services, including optional AI‑enabled capabilities.

Use of Data in AI

BillingPlatform does not use customer data to train public or third‑party generative AI models. Customer data processed by AI features is used only for the specific purpose of providing the AI functionality requested by the customer and is not retained for unrelated model training or improvement.

Data Minimization and Purpose Limitation

AI features are designed to access only the minimum data required to perform the requested task. Data is processed in accordance with the principle of purpose limitation and consistent with applicable data protection laws.

Security Controls

BillingPlatform applies enterprise‑grade security safeguards to AI‑enabled functionality, including:

  • Role‑based access controls
  • Encryption in transit and at rest

  • Segregation of customer environments

This AI Privacy Policy may be updated periodically to reflect changes in technology, regulations, or BillingPlatform practices. Material changes will be communicated in accordance with contractual commitments.

 

ARTIFICIAL INTELLIGENCE TERMS

These Artificial Intelligence Terms (the “AI Terms”) are an addendum to, and are hereby incorporated into, the Software-as-a-Service Agreement between Company and Customer, and other schedules and addenda incorporated therein (collectively, the “Agreement”). Capitalized terms not defined in these AI Terms have the meanings set forth in the Agreement. These AI Terms apply to the features and functionality of the Application Service that utilize artificial intelligence (“AI”) capabilities, including any “copilot,” “assistant,” recommendation, summarization, extraction, prediction, classification, or generative functionality (collectively, “AI Features”). These AI Terms are part of the Agreement that governs Customer’s access to and use of AI Features.

1. DEFINITIONS.

  • 1.1 “AI Input” means Customer Content, including prompts, instructions, queries, files, data, or other information, submitted by Customer in connection with Customer’s use of AI Features, including feedback and ratings suggested by and/or submitted by Customer’s Authorized End Users in connection with the AI Features.
  • 1.2 “AI Output” means any content, results, recommendations, summaries, classifications, predictions, responses, or other outputs generated by AI Features.
  • 1.3 “AI Model” means any machine learning or artificial intelligence model (including large language models), whether provided by Company or a third party, used to provide AI Features.
  • 1.4 “Third-Party AI Provider” means any third-party provider of any AI Model, AI-enabled technology or service leveraged in the Application Service to provide AI Features (including via API).

2. NATURE OF AI FEATURES; CUSTOMER RESPONSIBILITIES.

  • 2.1 Nature of AI Features. Customer acknowledges that AI Features are probabilistic and may produce AI Output that is inaccurate, incomplete, non-unique, or not appropriate for Customer’s specific purpose. AI Output is provided for informational purposes only and may not be used for or to generate professional advice (including legal, financial, accounting, tax, or compliance advice). AI Output may be similar or identical to content generated for other users or customers.
  • 2.2 Human Oversight. Customer and Authorized End Users are solely responsible for validating all AI Output and determining whether to rely on such AI Output. Customer is solely responsible for configuring and administering access to AI Features by Authorized Users and for all decisions, actions, and omissions arising from Customer’s use of AI Features and AI Output including compliance with law.
  • 2.3 Prohibited Uses. Customer will not (and will not permit any Authorized End User to) use AI Features: (a) in violation of applicable law or third-party rights, including use of any third-party data in an AI Input if Customer lacks authorization with respect to such data; (b) to generate individualized advice in circumstances where such advice would ordinarily be provided by a licensed professional (including legal, medical, or financial advice); or (c) to develop, train, or improve any model or system that competes with Company’s products or services.
  • 2.4 Representation and Warranty. Customer represents and warrants that it has all rights, permissions, and consents necessary to submit AI Input for processing by AI Features and to receive and use AI Output, including with respect to any personal data or sensitive information contained in AI Input.

3. COMPANY OBLIGATIONS.

  • 3.1 Processing to Provide AI Features. Company may process AI Input solely to provide the AI Features and the Application Service to Customer and to maintain, secure, support, and improve the AI Features and the Application Service.
  • 3.2 Third-Party AI Providers. Company may transmit AI Input to, and receive AI Output from, Third-Party AI Providers to provide the AI Features, and will require such Third-Party AI Providers to be subject to confidentiality and security obligations intended to protect AI Input from unauthorized access or disclosure.
  • 3.3 No Training on Customer Content/AI Input (Default). Company will not permit any Third-Party AI Provider on whose technology Company re to use Customer Content to train any AI Model for the benefit of any party other than Customer, unless Customer expressly opts in via a written amendment executed by authorized representatives of both Parties that describes the scope, purpose, and data handling.
  • 3.4 Aggregated Statistics. For clarity, nothing in these AI Terms limit Company’s rights under Section 2.7 (Aggregated Statistics), provided that such Aggregated Statistics do not identify Customer or disclose Customer Confidential Information.

4. OWNERSHIP & CONFIDENTIALITY

  • 4.1 Customer Content and AI Input. As between the Parties, Customer retains all right, title, and interest in and to Customer Content and AI Input, subject to the rights granted to Company under the Agreement and these AI Terms.
  • 4.2 AI Output. As between the Parties, Customer will own AI Output generated from Customer’s AI Input, excluding Company Confidential Information, Company’s pre-existing intellectual property, and any elements of the Application IP embodied in the AI Features or AI Output. AI Output will be treated as Customer Content (and Customer Confidential Information, if applicable) for purposes of the Agreement.
  • 4.3 Company Technology. Company retains all right, title, and interest in and to the AI Features, AI Models, Application IP, and any improvements, modifications, or derivative works thereof.

5. DISCLAIMERS AND CUSTOMER VERIFICATION.

WITHOUT LIMITING SECTION 7 OF THE AGREEMENT, THE AI FEATURE AND AI OUTPUT ARE PROVIDED “AS-IS.” COMPANY DISCLAIMS ALL WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF AI OUTPUT.

6. LIMITATION OF LIABILITY.

In addition to the limitations and exclusions of liability in Section 7 of the Agreement, Company shall have no liability for any damages arising from Customer’s use of, or reliance upon, the AI Features. Company’s indemnification obligations do not apply to any claim arising from or relating to (a) AI Output, (b) Customer’s or any Authorized End User’s reliance on AI Output, (c) AI Input supplied by or on behalf of Customer, or (d) Customer’s use of AI Features in violation of these AI Terms.

7. ORDER OF PRECEDENCE; SURVIVAL; CHANGES AND AVAILABILITY.

If there is a conflict between these AI Terms and any other provision of the Agreement, these AI Terms shall control. These AI Terms will survive expiration or termination of the Agreement. Company reserves the right to discontinue any AI Feature for all Customers or for Customer only and to restore any AI Feature on the same or different terms than those currently offered.
